2. Scope

These terms apply to every order placed on wearcrave.com by a consumer. Crave sells and ships only to the countries listed in the shipping policy, which also lists the territories it does not serve. The site and these terms are available in English and in French. The French version prevails in case of discrepancy.

The essential characteristics of each product are stated on its product page.

4. Prices, payment and order

5. Delivery

Delivery methods, costs and usual delivery times are set out in the shipping policy, which forms part of these terms and states the maximum delivery time.

To withdraw online, use the Withdrawal page, reached from the Help menu in the footer of every page, and click "Withdraw from your order". You receive an acknowledgment of receipt by email with the content, date and time of your declaration.

7. Legal guarantees

Every product is covered by the legal guarantee of conformity (articles L. 217-3 and following of the French Consumer Code) and by the guarantee against hidden defects (articles 1641 and following of the French Civil Code). To exercise them, write to Crave as set out in article 10. The notice below is required by article D. 211-2 of the French Consumer Code and is a faithful translation of the official French text.

The consumer has a period of two years from the delivery of the good to obtain the implementation of the legal guarantee of conformity in the event of a lack of conformity. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it appeared.

Where the contract for the sale of the good provides for the continuous supply of digital content or a digital service for a period exceeding two years, the legal guarantee applies to that digital content or digital service throughout the intended supply period. During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or digital service and not the date on which it appeared.

The legal guarantee of conformity entails an obligation for the professional, where applicable, to provide all updates necessary to maintain the conformity of the good.

The legal guarantee of conformity gives the consumer the right to repair or replacement of the good within thirty days of the request, free of charge and without major inconvenience to the consumer.

If the good is repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.

If the consumer requests repair of the good but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the good.

The consumer may obtain a reduction of the purchase price while keeping the good, or terminate the contract and obtain a full refund against return of the good, if:

1° The professional refuses to repair or replace the good;

2° The repair or replacement of the good takes place after a period of thirty days;

3° The repair or replacement of the good causes major inconvenience to the consumer, in particular where the consumer definitively bears the costs of taking back or removing the non-conforming good, or bears the costs of installing the repaired or replacement good;

4° The non-conformity of the good persists despite the seller’s unsuccessful attempt to bring it into conformity.

The consumer is also entitled to a reduction of the price of the good or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination of the contract. The consumer is then not required to request repair or replacement of the good beforehand.

The consumer is not entitled to termination of the sale if the lack of conformity is minor.

Any period during which the good is immobilized for repair or replacement suspends the remaining guarantee until delivery of the repaired good.

The rights mentioned above result from the application of articles L. 217-1 to L. 217-32 of the French Consumer Code.

A seller who obstructs in bad faith the implementation of the legal guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of average annual turnover (article L. 241-5 of the French Consumer Code).

The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for a period of two years from the discovery of the defect. This guarantee gives the right to a price reduction if the good is kept, or to a full refund against return of the good.

8. Product safety

The safety warnings of each product, the identity and postal address of the manufacturer and the product safety contact address are shown on its product page, and the warnings are repeated in the leaflet included in each parcel.

9. Personal data

The processing of your personal data and your rights are described in the privacy policy.

10. Complaints and mediation

For any complaint, write to Crave first at contact@wearcrave.com or through the contact form, with your order number. If your written complaint has not been resolved, you may refer the dispute free of charge, within one year of that complaint, to the consumer mediator to which Crave belongs, CM2C, Centre de la Médiation de la Consommation de Conciliateurs de Justice, 49 rue de Ponthieu, 75008 Paris, France, www.cm2c.net (articles L. 612-1 and following of the French Consumer Code). Mediation is optional and you remain free to bring the dispute before a court.

11. Governing law

These terms and every order placed on the site are governed by French law. If you reside in another Member State of the European Union, this choice does not deprive you of the protection of the mandatory provisions of the law of your country of residence (article 6 of Regulation (EC) No 593/2008, Rome I).
